RHA Wins Ruling on Off-Road Driving
The Road Haulage Asssociation has gained clarification from VOSA as to what will be accepted as driving off the public highway that need NOT be recorded as driving time under the new EU Regulation 561/2006.
Following continuing discussions, VOSA confirms that the following movements need not be recorded as driving time: a lorry requested to move a load on a journey starting and finishing within the site, for example a quarry, and not going on to a public highway; and a tractor unit moving within a distribution depot having uncoupled from a trailer, up to the point that it re-couples to that or another trailer.
RHA Director of Policy, Jack Semple said: "The key issue is the meaning of the word 'journey', used in the Regulation. There is no legal definition; ultimately, if an operator has a different view to that of VOSA, only the courts can decide. We have been pursuing this issue for some time and this clarification will be good news for hauliers in reducing the impact, to some degree, of 561/2006.
